Welcome to Men.tality® (“Men.tality,” “the Company,” “we,” “us,” or “our”), a private membership and matchmaking network operated by Men.tality, accessible at datingmentality.com (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, membership program, coaching services, live events, and any related services (collectively, the “Services”).

By creating an account, submitting a membership application, or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1.1 Eligibility

You must be at least 18 years of age to apply for or use the Services.
Men.tality is a curated, application-based membership. Acceptance is at the sole discretion of the Company. Submitting an application does not guarantee membership.
You represent that all information provided during application, onboarding, and profile creation is truthful, current, and accurately represents you as a real, single, and available individual seeking a genuine relationship or coaching engagement.

1.2 Nature of the Service

Men.tality is a relationship coaching, matchmaking, and referral-based membership service. It is not:

A casual dating or “hookup” app
An escort, companionship-for-hire, or paid-date arrangement service
A social media platform for public content sharing

Membership does not guarantee introductions, matches, dates, or any specific outcome. Men.tality facilitates connections and provides coaching, education, and community access; it does not guarantee romantic or relationship success.

1.3 Member Conduct and Prohibited Use

By using the Services, you agree not to:

1. Create or maintain a fictitious, impersonated, or misleading profile — including false photos, false identity claims, false relationship status, or misrepresentation of age, appearance, or intentions.

2. Use the Services to offer, solicit, or advertise escort services, companionship-forcompensation, or any transactional arrangement tying money or gifts to romantic or physical contact.

3. Post, share, or transmit nudity or sexually explicit content, images, video, or descriptions of any kind, on the platform, in profiles, in messaging, or at any Men.talityaffiliated event.

4. Host, promote, or solicit participation in cam shows, live adult performances, or adult streaming of any kind.

5. Organize, promote, or facilitate swinger meetups, group sexual encounters, or non-monogamous solicitation events through the platform or under the Men.tality name.

6. Use the Services to facilitate mail-order bride arrangements, international marriage brokering for compensation, visa-for-marriage schemes, or any arrangement prohibited under the International Marriage Broker Regulation Act (IMBRA) or equivalent law.

7. Harass, threaten, defraud, financially exploit, or extort any other member.

8. Use the Services for any unlawful purpose, including but not limited to solicitation of minors, trafficking, or financial scams (“romance scams”).

9. Scrape, copy, or redistribute member data, photos, or content.

10. Misrepresent your identity, marital status, or intentions to any coach, matchmaker, staff member, or fellow member.

Violation of any of the above will result in immediate suspension or termination of membership without refund, and may be reported to law enforcement where applicable.

1.4 Content Monitoring and Enforcement

See Section 4 (Content Monitoring & Platform Safety Policy) below, which is incorporated by reference into these Terms.

1.5 Membership Fees and Billing

See Section 2 (Billing Terms) below, which is incorporated by reference into these Terms.

1.6 No Guarantee; Disclaimer of Warranties

The Services are provided “as is” and “as available.” Men.tality makes no warranty, express or implied, regarding the outcome of coaching, matchmaking introductions, or event participation. Any relationship, romantic outcome, or personal result is dependent on factors outside the Company’s control.

1.7 Limitation of Liability

To the maximum extent permitted by law, Men.tality, its owners, employees, coaches, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Services, including but not limited to emotional distress, financial loss, or damages arising from interactions with other members or introduced parties. Members interact with and meet other individuals at their own risk. Men.tality strongly recommends standard dating safety practices (public first meetings, informing a friend of plans, video verification before in-person meetings).

1.8 Termination

Men.tality reserves the right to suspend or terminate any membership, with or without notice, for violation of these Terms, non-payment, or conduct the Company deems harmful to the community or brand.

1.9 Dispute Resolution

Any dispute arising from these Terms shall first be addressed through good-faith negotiation between the parties. If the dispute is not resolved within [30] days of written notice, it shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Los Angeles County, California. Each party shall bear its own attorneys’ fees unless otherwise awarded by the arbitrator. These Terms and any dispute arising from them shall be governed by the laws of the State of California, without regard to its conflict-of-law provisions.
